Photo & Mirror Booth Terms and Conditions
PAYMENT - A non-refundable deposit in the amount of 40% of the total cost is required in order to reserve the date. The remaining amount is due 14 days prior to the client’s event. The date is reserved once the deposit is received. Sales tax will be added to all transactions at current rates.
DATE CHANGE & CANCELLATIONS - Any request for a date change must be made in writing at least thirty days in advance of the original event date. Change is subject to photo booth availability. If there is no availability for the alternate date, the deposit shall be forfeited and event cancelled. Any cancellation occurring less than 14 days prior to the event date shall forfeit all payments received.
ACCESS, SPACE, POWER - New York Sublime Events Photo Booth will arrive approximately one hour before scheduled rental start time to setup equipment. Client will arrange for an appropriate space for the photo booth at event's venue. Client is responsible for ensuring power is available for the photo booth, (120V, 15 amps, 3-prong outlet within 10 feet of desired set-up area). All electrical must adhere to contemporary safety standards and supplies at least 15 amps. Client accepts full responsibility and is liable for any damages, injuries or delays that occur as a result of failure to comply with these provisions. Any delay in the performance or damage to the photo booth equipment due to improper power is the responsibility of the client.
New York Sublime Events Photo Booth agrees to have a photo booth operational for a minimum of 85% during this period; occasionally, operations my need to be interrupted for maintenance of the photo booth (changing photo paper, adjusting camera, adjusting printer, etc)
DAMAGE TO PROVIDER'S EQUIPMENT - Client acknowledges that it shall be responsible for any damage or loss to the Provider's Equipment caused by any misuse of the Provider's Equipment by Client or its guests.
INDEMNIFICATION - By terms of the rental agreement, New York Sublime Events Photo Booth is to be held harmless from any liability from use of the equipment. New York Sublime Events Photo Booth is not responsible for accidents or injuries caused directly or indirectly in the use of rented items.
Client agrees to assume full responsibility and liability for any and all claims arising out of the use of the photo booth or its booth attendants. New York Sublime Events Photo Booth will not be held liable for any injury, loss or damage directly or consequently arising out of the use or rental of the photo booth. Client will indemnify New York Sublime Events Photo Booth against, and hold New York Sublime Events Photo Booth harmless from all claims, actions, proceedings, costs, damages, and liability including attorney’s fees, arising out of, in connections with, or resulting from the rental of New York Sublime Events Photo Booth.
COI - If Certificate of Insurance (COI) is required please e-mail us your building requirements at least 3 business days before scheduled delivery and a small fee will be added to your invoice.
MODEL RELEASE - Client agrees to, and understands the following: All guests using the photo booth hereby give to New York Sublime Photo Booth the right and permission to copyright and use, photographic portraits or pictures of any photo booth user who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose. In addition, Client hereby releases, discharges and agrees to save harmless New York Sublime Photo Booth from any liability that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.
New York Sublime Events Photo Booth reserves the right to use photos in our photo booths, websites and social media for marketing purposes unless otherwise noted in writing prior to set up.
PERMITS - Clients are responsible for all applicable permits required by City, Town and other public entities.
